The Supreme Court, in a unanimous ruling by a five-man panel of judges, rejected an appeal lodged against Adeleke by Prince Dutton Babaime who had sued the governorship ticket of the PDP..

Babayime emerged from a parallel primaries held by a faction of the party in the state.

The appellant’s counsel, Mr. Adebayo Adelodon, withdrew the appeal after the panel chaired by Justice Amina Augie drew his attention to the fact that the case was a barred case.

The Panel confirmed that the appeal was incompetent, stressing that it was filed outside the 14-day period stipulated by law.
